One of the contributing factors to this award (to NTP) was RIMs apparant refusal to discuss or negotiate a settlement with NTP. Recent articles in the Wall Street Journal describe a legal arrogance. Evidently RIM seemed to feel that the initial case had no merit, and after they lost that, that any award would be tossed on appeal. The WSJ article points out that at various points along the way the possibility of settlement was profferred. It should also be noted that there are many more patent infringement cases each year that no one ever hears about because the parties involved reach an agreement before it ever goes to trial. The remarkable thing about this case was that it indeed went to trial, and hence became a part of the public record. Dave
